On 12/06/23, On November 29, 2023, the Court construed the Receiver’s requests to ratify orders sought by the vacated receivership to sell three properties as motions to appoint appraisers, approve appraisals, and set hearings for authorizing the sale of the Rock Creek Property, the Frisco Gate Property, and the Amerigold Suites. Dkt. No. 420. Defendant Timothy Barton (“Defendant” or “Barton”) opposes those motions, as construed by the Court, and what essentially amounts to a revival of the original motions to which the Court’s order refers.
